Terms of Service
Last updated: 2026-05-01 · Effective: 2026-05-01
These Terms govern your use of the Noren Up website hosting service ("Service") provided by Correlate Design GK ("Noren Up", "we", "us"). By subscribing, you agree to these Terms.
1. Who we are
Noren Up is operated by Correlate Design GK, a Japanese limited liability company.
- Address: 2-22-20 Hakusan, Bunkyo-ku, Tokyo 112-0001, Japan
- Contact: hello@noren-up.com
2. The Service
We design, host, and maintain a website on your behalf in exchange for a recurring subscription fee. This includes:
- A published website at the URL we agree on, hosted on our infrastructure;
- Initial content drafted from publicly available information about your business;
- Reasonable content updates by request via email;
- Support during U.S. business hours.
3. Subscription, automatic renewal, and your right to cancel (important)
Your subscription renews automatically until you cancel. Here is exactly what you are agreeing to:
- What you will be charged: the price shown on the order page at the time you subscribe.
- How often you will be charged: every month (monthly plan), every 12 months (annual plan), or once upfront (2-year prepaid plan), starting on the day you subscribe.
- How to cancel: see Section 4. Cancellation is always free and takes effect at the end of the current billing period.
- Where to find your renewal date: in any billing email from Stripe, or by emailing us.
Prices are in U.S. dollars. We may change prices for future renewals on at least 60 days' notice by email. If we raise your price, your existing subscription is grandfathered at the old price for at least the remainder of the term you have already paid for, and for the next 60 days on monthly plans. You may cancel before any price increase takes effect.
4. Cancellation — as easy as signup
You can cancel any time, by any of these methods:
- Reply to any email we send you with the word "cancel";
- Email hello@noren-up.com from your account address;
- Click the cancellation link in any monthly billing receipt.
We confirm cancellations within one business day. Cancellation takes effect at the end of the current billing period. Your site stays live through the period you have already paid for, then comes down. We do not pro-rate refunds for partial months. See our Refund Policy for satisfaction-guarantee details.
5. 30-day money-back guarantee (monthly & annual plans)
If, within 30 days of your first paid invoice on a monthly or annual plan, the Service does not match what you saw in the preview email or fails to meet a reasonable expectation we set, email us and we will refund that first payment in full and remove the site. This guarantee is available once per customer (one site per business). The 2-year prepaid plan is non-refundable except where required by applicable consumer-protection law (see Section 6).
6. Prepaid annual and 2-year plans
- Annual plan ($790/year): Refundable on a pro-rated basis within the first 30 days. After day 30, non-refundable; the subscription continues for the remainder of the paid term and you can cancel auto-renewal at any time.
- 2-year prepaid plan ($1,327, 30% discount): Non-refundable except where applicable U.S. state consumer-protection law requires otherwise. You acknowledge this at checkout. The subscription does not auto-renew at the same discount; we will email you 60 days before the term ends with renewal options.
7. After cancellation
When you cancel, your subscription does not renew. The site remains live through the end of the period you have paid for, then comes down. We retain your account data for the period described in our Privacy Policy. You may request an export of your published content (HTML + assets) within 30 days of cancellation at no additional cost.
8. What's yours, what's ours
- Your content (logos, photos, copy you provide) remains yours. You grant us a non-exclusive license to host and display it for the purpose of running your site.
- Our templates and infrastructure (design code, deployment pipeline) remain ours. You don't get a copy on cancellation.
- AI-generated content we initially produced on your behalf becomes yours upon your first paid invoice. Until then, it is a marketing preview owned by us.
- Domain name: if you bring your own domain we don't take ownership. If we register one for you, we'll transfer it on request after your first 90 days of paid service.
9. Acceptable use
You agree not to use the Service for: illegal content, harassment, malware distribution, unsolicited bulk email, infringing copyrighted work, content that violates U.S. export controls, or content that would put our payment processor's account at risk. We may suspend sites we reasonably believe violate this section after one written notice and 48 hours to cure (or immediately for severe abuse).
9.1 Customer-supplied content — your representations
When you upload, paste, or otherwise provide content to the Service (logos, photos, copy, customer reviews, testimonial text, etc.), you represent and warrant that:
- You own the content, or you have all necessary rights, licenses, and consents from the content's authors and any depicted persons to display it on a website operated by you;
- For customer reviews and testimonials specifically: you have the right to reproduce the review text in this commercial context (note that the original reviewer typically retains copyright in the review text — pasting a review you found on Google, Yelp, or similar platforms onto your own marketing site is a separate copyright question from the platform's terms of service, and is your responsibility to clear);
- The content does not infringe any third party's intellectual property, privacy, publicity, or other rights;
- The content does not contain personal data of others without their consent.
You agree to indemnify, defend, and hold harmless Correlate Design GK and its operators from any third-party claim, demand, loss, damage, cost, or expense (including reasonable legal fees) arising from content you provided that breaches the representations above. Our DMCA designated agent and takedown procedure are described in Section 19.
10. Service availability
We aim for 99.9% monthly uptime via Cloudflare's global infrastructure. We do not commit to a formal SLA at this stage; the Refund Policy describes the only credit we extend for service interruptions and supersedes anything we may say casually elsewhere.
11. Disclaimers
The Service is provided "as is" and "as available". We disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement to the maximum extent permitted by applicable law.
12. Limitation of liability
To the maximum extent permitted by law, our total aggregate liability for any claim arising out of or relating to the Service is limited to the fees you paid us in the twelve (12) months preceding the claim. We are not liable for indirect, incidental, consequential, exemplary, or punitive damages. Some U.S. states do not allow these limitations; in those states, our liability is limited to the smallest amount permitted by law.
13. Termination by us
We may terminate your account on 30 days' written notice for any reason, or immediately for material breach of Section 9. On termination by either party we will, on request, export your published content in a portable format (HTML + assets) within 30 days.
14. Governing law and dispute resolution
These Terms are governed by the laws of Japan, without regard to its conflict-of-law rules. Mandatory consumer-protection laws of your jurisdiction always apply where they cannot be waived; nothing in these Terms reduces those rights.
Informal resolution first. Any dispute begins with 30 days of good-faith email discussion. We can usually resolve issues there.
Small-claims carve-out. Either party may bring a claim in the small-claims court of the customer's home state or country, for amounts within that court's jurisdiction. We will not move the case to arbitration over your objection.
Arbitration for larger claims. If a dispute cannot be resolved informally and exceeds the small-claims limit, it will be resolved by binding arbitration administered by the Japan Commercial Arbitration Association under its rules then in effect, conducted in English in Tokyo or by video conference at the customer's option. Class actions and class arbitrations are waived to the maximum extent permitted by law.
15. Changes to these Terms
We will email you at least 30 days before any material change to these Terms. Continued use after the effective date constitutes acceptance. If you do not agree to a material change, you may cancel before the effective date and we will refund any unused prepaid term on a pro-rated basis.
16. State-specific notices
California residents: You may exercise rights under the California Automatic Renewal Law (Bus. & Prof. Code §§17600–17606). Cancellation is available online by email and through the cancellation link in any billing receipt, as described in Section 4. You may also contact hello@noren-up.com for assistance with any auto-renewal question.
New York residents: You may cancel under New York General Business Law §527-a using the methods in Section 4.
Other states: Where Florida (§501.165), Oregon (SB 60), Vermont (9 V.S.A. §59), Illinois (815 ILCS 601), or any other state imposes additional auto-renewal disclosure or cancellation requirements, those rights apply to you and are incorporated here by reference.
17. Force majeure
Neither party is liable for failure or delay caused by events beyond reasonable control, including but not limited to natural disasters, war, civil disturbance, government action, internet or third-party-provider outages, pandemics, or labor disputes. The affected party will use reasonable efforts to resume performance and notify the other party as soon as practical.
18. Assignment
You may not assign these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, sale of assets, or by operation of law, provided that the assignee assumes our obligations to you. We will give you 30 days' notice of any such assignment, and you may cancel without penalty if you object to the assignment.
19. Copyright (DMCA)
If you believe content on a site we host infringes your copyright, send a written notice to our designated agent containing the elements required by 17 U.S.C. §512(c)(3): your physical or electronic signature, identification of the copyrighted work, identification of the allegedly infringing material with sufficient detail for us to locate it, your contact information, a statement of good-faith belief that the use is unauthorized, and a statement under penalty of perjury that your notice is accurate and you are authorized to act on the copyright owner's behalf.
